La maternidad subrogada y la impugnación judicial de paternidad en el Perú

Este trabajo tiene como objetivo determinar la causa fundamental de la impugnación de paternidad en los casos de maternidad subrogada en el Perú. Se trabajó con los métodos: analítico, sintético, inductivo, deductivo, doctrinario, hermenéutico y el método exegético. La unidad de análisis estuvo constituida por 9 jueces superiores de la Corte Superior de Justicia de La Libertad, 5 jueces de familia de la Corte Superior de Justicia de La Libertad, 6 docentes universitarios especializados en el área de Derecho Civil de la Universidad Privada Antenor Orrego, Universidad Privada Cesar Vallejo y Universidad Nacional de Trujillo y 5 fiscales especializados en familia del distrito fiscal de La Libertad. Se determinó que la causa fundamental de la impugnación de paternidad con los casos de maternidad subrogada en el Perú se debe a la deficiente regulación de la maternidad subrogada, lo que da lugar a la interposición de este tipo de procesos impugnatorios.

Abstract

This paper aims to determine the fundamental cause of the challenge of paternity in cases of surrogacy in Peru. We worked with the following methods: analytical, synthetic, inductive, deductive, doctrinal, hermeneutic and exegetical. The unit of analysis was constituted by: 9 superior judges of the Superior Court of Justice of La Libertad,5 judges of the Superior Court of Justice of La Libertad, 6 university professors specialized in the Civil Law area of the universities: Antenor Orrego Private University, Cesar Vallejo Private University and Trujillo National University and 5 family prosecutors in the fiscal district of La Libertad. It has been observed in the course of the present investigation that the fundamental cause of the challenge of paternity with cases of surrogate mother hood in Peru is due to the poorregulation of surrogacy which gives rise to the interposition of this type of impugning process.
